Slip and Fall Accidents

With every winter and spring comes new clients who have been injured in “slip and fall” accidents. These accidents are due to the storms the New York Metropolitan area routinely experiences and the failure of property owners to clean up afterward. Injuries these clients suffer include: neck and back injuries, broken or sprained ankles, broken or sprained wrists, a variety of knee injuries, and various other bodily injuries.

Who is responsible for my slip and fall accident?

An owner is responsible for cleaning up the property after a snow storm. For example, an owner of a business is responsible for making sure its parking lots and walkways are cleared of snow. This is so that customers of the business will be able to safely in and about the business premises.

An owner of an apartment complex, housing development, cooperative, or condominium is also responsible for safely maintaining walk ways. When a snow storm occurs, and an owner fails to clean up properly, these property owners can be held responsible for any injuries that result. If a tenant or one of their guests has a slip and fall accident, the owner may be liable.

Navigating your Slip and Fall Accident

There are a number of things that must happen for a plaintiff (i.e., a person who is injured) to have a successful slip and fall case. First, the plaintiff’s attorney must identify the individual, business or organization responsible for maintaining the area where the plaintiff was injured. Next, the plaintiff must show that the entity responsible knew or should have known about the dangerous condition caused by the snow or ice, or that the responsible entity created the condition. Last, the plaintiff must show that he or she was damaged (i.e., injured) in some way by the accident. This could be economic damages, such as lost wages, due to time out from work or money spent on hospital bills. This could also be non-economic damages, such as pain and suffering.
